Terms of Service

1. Acceptance of Terms

By connecting a wallet to Token Clash ("the game", "the service", "we", "us"), you agree to these Terms of Service ("Terms"), our Privacy Policy, and our Legal Disclaimers. If you do not agree, do not connect a wallet or use the service.

2. Eligibility

You may use Token Clash only if:

  • You are at least 18 years old
  • Participation in skill-based games for cryptocurrency prizes is legal in your jurisdiction
  • You have not been previously banned for cheating or violations
  • The funds you use are legally sourced and not subject to sanctions

You are responsible for verifying that your participation complies with local law. Some jurisdictions restrict or prohibit cryptocurrency or skill-game-for-prize activities.

3. Service Description

Token Clash is a competitive trading card game where:

  • Cards are minted as compressed NFTs (cNFTs) on Solana
  • Players can purchase card packs using SOL
  • Players match against each other in ranked, KotH, or tournament modes
  • Match outcomes settle through on-chain escrow programs
  • Winners receive SOL prizes minus platform fees (currently 13% — 8% operations, 5% community pool)

4. Wallet & Account

Your account is bound to your Solana wallet address. You are solely responsible for the security of your wallet, seed phrase, and devices. We cannot recover lost wallets. There is no password reset.

You are responsible for all activity originating from your wallet, regardless of whether you authorized it.

5. Pack Purchases & NFTs

5.1 Pricing & Tiers

Pack prices are denominated in SOL and shown at point of purchase. Card distribution probabilities (rarity odds) are published in the FAQ.

5.2 No Refunds

All pack purchases are final. Once a pack is committed and revealed on-chain, the resulting NFTs are permanently in your wallet. We do not offer refunds for pack contents, perceived value, market fluctuations, or RPC errors that successfully completed on-chain.

5.3 Random Outcomes

Pack contents are determined by on-chain randomness (commit-reveal scheme with slot-based entropy). The "pity" system increases the floor of guaranteed rarities for unlucky streaks but does not guarantee specific cards.

5.4 NFT Ownership

Cards minted as cNFTs are owned by you and tradable on supported Solana marketplaces (Tensor, Magic Eden, etc.) outside the game. Token Clash does not control marketplace pricing, listings, or transactions.

6. Match Entry Fees & Prizes

Ranked, KotH, and Tournament matches require an entry fee that is escrowed on-chain. Winners receive the pot minus the platform fee. Match outcomes are determined by gameplay; we use deterministic match-state validation server-side and finalize results to chain via the escrow program.

Prizes are not guaranteed. Smart contract failures, network outages, or escrow disputes may delay or prevent prize distribution. We reserve the right to reverse or recompute prize allocations in the case of confirmed cheating, exploits, or smart-contract bugs.

7. Acceptable Use

You agree NOT to:

  • Use bots, scripts, or external tools to automate gameplay (the in-game Auto-Battle is permitted)
  • Exploit bugs or unintended behaviors in the smart contracts or game logic
  • Collude with other players in matches that are advertised as competitive
  • Engage in match-fixing for the purpose of redirecting prizes
  • Use the service to launder funds or evade sanctions
  • Reverse-engineer, decompile, or attempt to compromise the smart contracts or server beyond legitimate research disclosure channels
  • Harass other players via the in-game inbox or public chat features

8. Termination & Bans

We may suspend or ban any wallet found to be in violation of these Terms. In severe cases (proven cheating, fraud, sanction-list activity) we may also:

  • Revoke unclaimed in-game rewards
  • Reverse fraudulent prize distributions where on-chain reversal is technically possible
  • Refuse future service to associated wallets

Bans are at our sole discretion. We will, where reasonable, notify the banned wallet via inbox of the reason for the action.

9. Intellectual Property

The Token Clash game code, server software, card art, hero designs, sound effects, music, and branding are the intellectual property of the project owners. You receive a non-exclusive license to use these in connection with playing the game.

You retain ownership of your NFT cards and may freely trade them. The license to display card artwork follows the NFT — buyers of your card receive the same display rights you had.

Card names and references to real crypto assets are used nominatively for identification and satire. Token Clash is not affiliated with, endorsed by, or sponsored by any referenced project. See our Legal Disclaimers.

10. Disclaimers & Limitation of Liability

The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by law, our aggregate liability to you for any claim arising from your use of the service is limited to the lesser of (a) the total amount you spent on pack purchases and entry fees in the 90 days preceding the claim, or (b) USD 500 equivalent in SOL.

We are not liable for: blockchain network failures, RPC outages, wallet provider issues (Phantom, Solflare, etc.), market value fluctuations, lost wallets or seed phrases, third-party marketplace disputes, taxation outcomes, or actions of other players.

11. Indemnification

You agree to indemnify and hold harmless Token Clash and its operators from any claims, losses, or expenses arising from your violation of these Terms, your use of the service, or your interactions with other players.

12. Changes to These Terms

We may modify these Terms at any time. The "Last updated" date at the top reflects the most recent revision. Material changes will be announced via in-game inbox. Continued use of the service after a change constitutes acceptance of the modified Terms. If you do not accept the changes, you must stop using the service.

13. Governing Law & Disputes

These Terms are governed by the laws of Germany, without regard to conflict-of-law rules. Disputes shall first be attempted to be resolved informally by contacting us at the email below. If informal resolution fails, exclusive jurisdiction lies with the competent courts in Germany.

EU consumers retain rights under mandatory consumer protection laws of their country of residence that cannot be derogated from by these Terms.

14. Severability & Survival

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Provisions that by their nature should survive termination (e.g., disclaimers, limitation of liability, IP rights) survive.
